This page (together with the documents referred to on it) tells you the terms on which you may make use of our website www.amuso.com and all other applications and websites operated by Project Amuso Ltd (our “Sites”), whether as a guest or a registered member. Please read these Terms of Use carefully before you start to use the Sites. By using our Sites, and/or registering as a “Member” you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using our Sites. You may access these Terms at any time by using the link to these Terms on the bottom of the Home page. We may revise these Terms at any time in accordance with Clause 11 below and your continued use of our Sites or your account with amuso (an “Account”) shall be deemed irrevocable acceptance of those revisions.
1. Information About us
- The Sites are operated by Project Amuso Limited (“we”, “us” and “our”). We are registered in England and Wales under company number 6337515 and have our registered office at Tower 42, Level 35 25 Old Broad Street London EC25 1HQ England
2. Accessing our sites
- Access to our Sites is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Sites without notice (see below). We will not be liable if for any reason our Sites are unavailable at any time or for any period.
- We restrict access to certain parts of our Sites to users who have registered with us. If you register with us, you must provide true and accurate information about yourself. Should the registration information provided prove false or misleading, we may suspend or terminate your account.
- You are not permitted to use the Sites or register with us unless you are thirteen (13) years of age or older. If you are not of majority (eighteen (18) in most jurisdictions) your parents must complete your registration and supervise your use. If we believe that you are under 13 and have registered with us, we will terminate your account.
- You are not permitted to use the Cash Version of any Games, unless you are sixteen (16) years of age or older, and you have permission from the bill payer to make a cash deposit on our Sites; or you are eighteen (18) years of age or older and have the legal capacity to contract with us.
- If you choose a password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any account or password if, in our reasonable opinion, your account information has been compromised. You must tell us immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
3. Services
- Our Sites allow users to create and participate in certain multimedia games (the “Games”) with other members. Each Game is subject to these Terms of Use, our General Game Rules, which can be accessed, and any specific game rules which are established by the creator of the Game.
- The Games are, in fact, games of pure skill and there is no chance element to them. Thus, when participating in a Game with other members it is your skill and speed in playing the Game that is assessed against other Members, and the winner will be the Member who, through skill or judgment, generates the highest score in the relevant Game. You should familiarize yourself with our general Game rules, and the specific Game rules established by the creator of the game, by reading the rules and instructions in the Game description before you play.
4. Interactive Services
- We provide certain interactive services through our Sites, including, without limitation:
- Games.
- Forums for discussion of issues of interest to the users of our Sites.
- Social networking services where users can create online personal profiles and interact with other members.
- Any use of our interactive services should comply with our content standards below.
- We do not actively oversee, monitor or moderate the content that you upload to our Sites and neither do we actively vet or screen users of our Sites. You use the Sites at your own risk and you should take care with the information you post on our Sites or that you provide to other users.
5. Third Party Services
- We may from time to time make available through our Sites certain services provided by third parties.
- Please note that these services are not provided by us but third parties. To gain access to these services, you must register with these third parties and deal with them direct. We have no control over the contents of those third party sites or the performance of these services. Accordingly, you use these services at your own risk and we accept no responsibility for them or for any loss or damage that may arise from your use of them.
6. Registration and membership
- To become a Member eligible to access non-Cash Versions, you must be at least 13 years old, register for the Sites and establish an Account with us. By registering and establishing an Account with us you expressly confirm that:
- o you are at least 13 years of age;
- To become a Member eligible to access Cash Versions, you must be at least 16 years old, register for the Sites and establish an Account with us. By registering and establishing an Account with us you expressly confirm that:
- are at least 16 years of age, and have parental authorization to play cash games; or
- 18 years of age you are able to enter into a legally binding agreement with us;
- In addition, as a Member you expressly confirm that:
- you will not use the Games while you are located in a country or jurisdiction that does not allow you to play the Games (if you are not sure, you should check before you play any of the Games for money);
- you are not a licensed bookmaker or a bookmaker’s agent, employee of ours or any associated company of ours and that you do not conduct a business of negotiating or receiving bets;
- you are not depositing money that does not belong to you, which has been gained from criminal or other illegal activity or with a credit, debit or charge card that does not belong to you;
- you are not bankrupt;
- you understand that by using the Games you may lose money that you may pay to play a Game and accept that you are fully responsible for any such loss;
- you will not use the Sites for any purpose that is unlawful or prohibited by these Terms; and
- It is your responsibility to ensure that national, state or other laws to which you are subject to do not adversely affect your right to participate in or play the Games.
- If you decide to become a Member, or to enter a Game, the Game in question will be made immediately available for your use. As a result you will not have the right to cancel these Terms or to any refund of monies you pay once you have started to play a Game and the applicability and enforceability of these terms and conditions shall not be affected by any “cooling-off” period once you have played a Game.
- You undertake to register for the Sites using accurate and current information about yourself including your age, full name and surname, place of residence and a valid email address. You agree to only register one Account with us. You understand and agree that if you provide inaccurate information to us we will close your Account. If you are asked for and provide details of a credit, debit or charge card, you must ensure that (a) you are fully entitled to use that card, and (b) it has available funds sufficient to cover the charges that are deducted from it.
- You will not allow anyone else to use your login details or give them to anyone else. If you do, you accept full responsibility for the consequences of this and agree to fully indemnify and hold us harmless from any damage or harm that may result.
- All deposits that you make with us from time to time shall be kept separate and distinct from the funds of ours and shall be managed and administered by any one of our companies.
- If no transaction has been recorded on your Account for thirty months, we will remit the balance in your Account to you. If we are unable to locate you we reserve the right to donate such funds to a registered charity of our choice or as set out in clause 16. Our employees, investors and subsidiary companies are allowed to take part in Games for the purpose of testing the user experience, but may not withdraw money or prizes for themselves.
7. Games, winners and prizes
- The number of players participating in a Game and their relative skills determine the result of all Games.
- The prize amount of all cash prize Games will be determined by the number of participants in the Game. The indicated cash prize will reflect the total of all entry fees for the Game and will be distributed to the parties at the conclusion of the Game. Cash games will be open to as many players as wish to participate up to a certain time specified by us or the Game creator.
- Cash prizes will be deposited directly into a winning Member's Account and will usually be available within one week of a Game’s conclusion.
- Game rules, scoring and guidelines can be found in the General Game Rules accessible and in the specific Game descriptions. Any questions or comments regarding this information should be sent to our Customer Support using the dedicated form.
- Any amounts that are mistakenly credited as winnings to your Account remain our property and will automatically be transferred from your Account upon the error being noticed. Any winnings mistakenly credited to your Account yet withdrawn by you will constitute a debt owed by you to us in the amount of such wrongfully attributed winnings.
- * If you provide materially misleading, inaccurate or incomplete information in your Account, we will be entitled to terminate your Account and cause you to forfeit any prizes you may have won as well as exercise any legal remedies we may have as a result of such conduct.
8. Accounts
- A person may open only one Account, and it must be funded only by that person. We reserve the right to assess compliance with this requirement by checking for unique email addresses, real world addresses, credit card number and/or any other payment forms used to establish an Account.
- If any Member is discovered to have breached this requirement, We reserve the right to close the relevant Account and consolidate all or part of the funds in any additional Accounts into the original, legitimate Account. The maximum amount transferred, if any, will not exceed the total amount of deposits, less any withdrawal requests that have been paid on the additional Accounts. All winnings will be forfeited. Furthermore, we have the right to deduct its reasonable transactions costs of doing this from the amounts being transferred to the original Account.
- Continued breach may, at our discretion, result in the termination of all the relevant persons Accounts and banning from the Games and the Sites. We reserve the right to terminate all affected Accounts if we conclude, acting reasonably, that more than one of such Accounts is being operated by, or is under the control of, a single person.
- We will not be liable to you for any loss that you may incur as a result of an unauthorized person accessing your Account and we accept no liability resulting from its unauthorized use, whether fraudulent or otherwise. As is usual, it is for you to ensure that your Accounts Password is kept completely secret.
- By opening an Account, you agree to allow us access to your Account to investigate complaints and/or other allegations of abuse.
- At the termination of an Account, a sum equal to the remaining amount of funds that may be withdrawn in the Account will be returned to you. Deposits of funds made in the Account, less any withdrawals that have been made on the Account, will be credited by means of a credit to the account that your most recent deposit originated. In some cases you may receive winnings from the Games in the form of a cheque by post.
- Where we have a serious and reasonable suspicion of fraudulent activity on an Account, we reserve the right to withhold the payment of withdrawable funds to a Member until the end of the charge-back period which applies to the payment method used to pay in the relevant funds.
9. Legality
- We may monitor the location from which you appear to access the Games and, may use techniques which are intended to block access from any location in which participation in the Games may be illegal or restricted as we may determine in our sole and absolute discretion from time to time. Accordingly, We may require a Member receiving any prize to provide proof that he or she is eligible to participate and if we determine in our sole and absolute discretion that you are not eligible, we may refuse to award the prize.
- You must comply with the laws which apply to you in the location you access the Games from. If any laws applicable to you restrict or prohibit your participation in the Games, then you must comply with those legal restrictions.
- Prohibited US states - Cash Games. If you live in the following states you are not eligible to play cash Games:

10. Acceptable use
- You may use our Sites only for lawful purposes. You may not use our Sites:
- in any way that breaches any applicable local, national or international law or regulation;
- in any way that artificially or unfairly influences or manipulates the result of a Game;
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards in clause 7 below;
- to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material;
- to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
- You also agree not to access without authority, interfere with, damage or disrupt:
- any part of our Sites;
- any equipment or network on which our Sites is stored;
- any software used in the provision of our Sites; or
- any equipment or network or software owned or used by any third party.
11. Content standards
- These content standards apply to any and all material you upload to or post on the Sites including the images and other content you upload as a result of creating or participating in a Game, your comments in forums and online discussions and the content you include in your personal profile and your communications with other users (“Content”) and your use of the Sites.
- You must comply with the spirit of the following standards as well as the letter.
- Content must:
- be accurate (where they state facts);
- be genuinely held (where they state opinions);
- comply with applicable law in the UK and US and in any other country from which they are posted.
- Content must not:
- contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory;
- promote sexually explicit material, violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- infringe any copyright, database right or trademark of any other person;
- be likely to deceive any person or made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence or promote any illegal activity;
- be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person;
- be used to impersonate any person, or to misrepresent your identity or affiliation with any person or give the impression that they emanate from us, if this is not the case;
- advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
- You are solely responsible for the Content and the consequences of posting or publishing it through our Sites. By uploading or posting Content to the Sites, you agree that:
- you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use Content in the manner contemplated by the Sites and these Terms of Use;
- you have the written consent, release, and/or permission of each and every identifiable individual person in the Content to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Content in the manner contemplated by this Sites and these Terms of Use;
- you recognize that the Content you post or upload to the Sites is available to other users of the Sites and potentially anyone in the World so you must take care as to what Content you post or upload;
- you have paid or will pay all royalties, fees, and any other monies owing to any person by reason of any Content posted or uploaded by you to or through the Sites.
12. Abuse of the games
- Members may not use unfair methods to play the Games. Any technique which allows a Member to use anything other than pure skill in the conduct of a Game is unfair for these purposes. Such techniques may include, but are not limited to, multiple Accounts (see Clause 8 above), the use of program codes or commands or any adapted hardware or software to assist play, the impersonation of another Member, or deliberately losing Games for the purpose of getting a competitive advantage. Further, Members must not do anything that may cause a disruption or malfunction of the Games.
13. Alerting us
- If you see anything relating to the Games which appears to infringe these Terms, then please contact us to inform us of it by using the "Report Content" function, or by emailing us here.
14. Suspension and termination
- Failure to comply with the acceptable use or content standards in these Terms of Use constitutes a material breach of the Terms of Use upon which you are permitted to use our Sites, and may result in our taking all or any of the following actions:
- immediate, temporary or permanent withdrawal of your right to use our Sites;
- immediate, temporary or permanent removal of any posting or material uploaded by you to our Sites;
- disqualification from any Game and your right to claim any prize;
- issue of a warning to you;
- legal action against you including proceedings for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- disclosure of such information to law enforcement authorities or third party complainants as we reasonably feel is necessary or required;
- disclosure of your identity to any third party who is claiming that any material posted or uploaded by you to our Sites constitutes a violation of their intellectual property rights, right to privacy or other legal rights.
- The responses described in this clause are not limited, and we may take any other action we reasonably deem appropriate.
15. Fees
- There are standard fees for all cash Accounts as follows: Playing fee: Approximately 35% of the entry cost for a Cash Game represents a fee paid by you to us for hosting the Game. The remaining 65% of the entry cost goes into the player's prize fund to be paid by players to the winner(s) and creator(s) of the Games.
- Withdrawal Fee: Each withdrawal from your Account will incur a processing fee. If an Account balance (excluding any non-withdrawable funds) is lower than the withdrawal processing fee, the withdrawal request will not be completed. Any withdrawal will incur a withdrawal charge of that will be deducted from your account balance at the time of the withdrawal. Your account balance must therefore be able cover both the withdrawal cost and the withdrawal amount.
- We may add new or ancillary services from time to time which require the payment of fees either to us or a nominated third party on terms which will be provided to you at the time.
16. Unallocated member funds
- From time to time, we will hold funds which are not allocated to Members. This may occur for a number of reasons including where a Member’s winnings are forfeited, or if we are unable to place funds in an Account because it has already been closed by a Member. We may use these funds for a variety of purposes including using them for “Sponsored” Games, donations to registered charities, developing and improving the Sites and Games, or anything else that we believe appropriate.
17. Intellectual property righths
- We do not claim any ownership rights in your Content. After posting your Content to the Sites, you continue to retain all ownership rights in such Content and you continue to have the right to use your Content in any way you choose. By posting any Content on or through the Sites, you hereby grant to us a perpetual, non-exclusive, sub-licensable and royalty free license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through our Sites.
- Save for the Content, we are the owner or the licensee of all intellectual property rights in our Sites and in the material published on it. Those works are protected by copyright laws and treaties around the world. You may use these rights and the material solely for the purpose of using the Sites and our service in accordance with these Terms of Use.
18. Our sites change regularly
- We aim to update our Sites regularly, and may change the content at any time. If the need arises, we may suspend access to our Sites, or close it indefinitely. Any of the material on our Sites may be out of date at any given time, and we are under no obligation to update such material.
19. Reliance on information
- We do not claim that the information on any specific subject contained on our Sites is accurate, comprehensive, verified, complete or error free. Commentary and other materials posted on our Sites are not intended to amount to advice on which reliance should be placed.
- We therefore disclaim all liability (whether arising in contract, tort or otherwise) and responsibility arising from any reliance placed by any user on materials and information available through our Sites.
20. Information about you and your visits to our sites
- We process information about you in accordance with our privacy policy. By using our Sites, you consent to such processing and you warrant that all data provided by you is accurate.
21. Viruses, hacking and other offences
- You must not misuse our Sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Sites, the server on which our Sites is stored or any server, computer or database connected to our Sites. You must not attack our Sites via a denial-of-service attack or a distributed denial-of service attack.
- By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Sites will cease immediately.
- We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Sites or to your downloading of any material posted on it, or on any websites linked to it.
22. Linking to our sites
- You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
- You must not establish a link from any websites that is not owned by you.
- Our Sites must not be framed on any other sites, nor may you create a link to any part of our Sites other than the home page. We reserve the right to withdraw linking permission without notice. The websites from which you are linking must comply in all respects with applicable local, national or international law, regulation and good industry practice.
- If you wish to make any use of material on our Sites other than that set out above, please address your request to info@projectamuso.com.
23. Links from our sites
- Where our Sites contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
24. Our liability
- Our Sites is provided on an “as is” basis. Accordingly, we hereby expressly exclude:
- all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
- any and all liability (whether arising in contract, tort or otherwise) for any direct, indirect or consequential loss or damage incurred by any user in connection with our Sites or in connection with the use, inability to use, or results of the use of our Sites, any websites linked to it and any materials posted on it.
- This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
25. Non-Excluded liabilities
- If (a) there is a technical failure of the Games which causes, as a result, a Game to be uncompleted, and (b) it is determined by us with certainty that the responsibility for the failure lies completely within our control, then, after examining the cause of the malfunction, we will refund to your Account an amount up to the equivalent in entry costs that were charged to your Account for joining the particular tournament. We do not have any liability to pay winnings which may potentially have been won in an uncompleted tournament.
26. Jurisdiction and applicable law
- The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Sites although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.
27. Trade marks
- "Amuso" and "Project Amuso" are trade marks of Project Amuso Limited.
28. Variations
- We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.
