Official Game Rules
Project Amuso Limited (we, us and our) operates certain Games (“Contests” and “Trivia”) on www.amuso.com and other sites in accordance with these rules, our Terms of Use and Privacy Policy. Please read these rules, Terms of Use and Privacy Policy before entering any of our games. By participating in our Games you are taken to have agreed to these terms.
Official Contest Rules
1. Contest Overview
- Amuso Competitions (the "Contests") provide users with the opportunity to submit original photo and video of themselves that will be judged as set forth below to select winners for the Contest Period. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules, the applicable entry criteria found on the Overview page, and the Terms & Conditions of Project Amuso Limited, registered in the UK under company number # 6337515 (“Sponsor”), which shall be final and binding in all respects.
2. Eligibility
- The Contest is open to users who have Internet access and are thirteen (13) years of age or older at the time of entry. Employees of Project Amuso Limited and their respective subsidiaries, affiliates, parent companies, distributors, divisions, and agencies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all federal and local laws and regulations. Void where prohibited by law.
3. Sponsor
- The Contests are sponsored by Project Amuso Ltd, 107 Cheapside, London EC2V 6DN, United Kingdom.
4. Agreement to Official Rules
- Participation in our Contests constitute the full and unconditional agreement to and acceptance of these Official Rules by you, the entrant ("Entrant") and the decisions of Sponsor which are final and binding. Winning a Prize is contingent upon fulfilling all requirements set forth herein.
5. Timing
- The Entry Period is set forth in the Overview page of our Contests. Entries received prior to or after the Entry Period will be disqualified.
6. How To Enter
- To enter our Contests, you must first create a free account with the Sponsor by completing the short entry form found on the Submit page with the information requested, and follow the instruction to upload your material. The material submitted will be considered the Contest Entry. Entries must be the original work of the Entrant; must not infringe third-party’s rights; must be suitable for publication (i.e. may not be obscene or indecent); must not contain obscene or pornographic material, may not contain defamatory statements, may not invade privacy or other rights of any other person, firm or entity, may not in any other way violate applicable laws and regulations, and may not contain any copyrighted works (other than so owned by the Entrant). Entries containing prohibited or inappropriate content as determined by the Sponsor, in its sole discretion, to be inappropriate will be disqualified. Sponsor makes the final determination as to which Entries are eligible. Submission of an Entry grants Sponsor and its agents the unconditional right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the Entrant, whether or not such Entry is selected as a winning Entry. Entries that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in this Contest.
7. Judging
- All entries will be judged according to the Judging Criteria set forth on the Overview page. There will be a public vote online (“Judging”) where users will be asked during this Judging process to rate the quality of an Entry compared to other Entries. Only the votes of registered users will be counted. Automated methods of voting or Judging through multiple accounts are strictly prohibited. The winning entries will be determined based on Judging by Sponsor using proprietary ranking algorithms. Entrants agree that the Sponsor has the sole right to decide all matters and disputes arising from this Contest and that all decisions of the Sponsor are final and binding.
8. Notification of a Potential Winner
- Any Entrant whose entry is determined to be a winning entry will be notified that his/her entry was selected is a Potential Winner. Potential Winner cannot be declared a Winner until he/she has returned all required documentation and his/her eligibility has been verified by Sponsor. Potential Winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Potential Winner will be notified by e-mail. If a Potential Winner cannot be contacted/has not responded within the timeframe stated in the notification, the Entrant with the next highest score will be deemed the Potential Winner. Except where prohibited, Potential Winner may be required to sign and return to Sponsor, within five (5) days of being notified, an affidavit of eligibility and liability/publicity release in order to advance. If Potential Winner fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, the Entrant with the next highest score will be deemed a Potential Winner.
9. Prize
- Not all Games are for a prize. Prizes are only awarded for the Winners of a “Cash Game” and other “Sponsored Games” subject to these rules and our Terms of Use. Prizes are nontransferable and non-refundable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize with another prize of greater or equal value in the event that a prize or portion of prize is unavailable. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use.
10. General Conditions
- In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize from among the eligible entries received up to the time of the impairment; or (c) cancel the Contest and refund all Payments. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Publicity:
- Except where prohibited by law, participation in the Contest constitutes winner's consent to Sponsor's use of winner's entry (including without limitation any screen shots), name, likeness, voice, opinions and biographical information for promotional purposes in any media without further payment or consideration.
12. Rights to Contests Entries:
- Submission constitutes Entrant's certification that the entry is their own original work and does not infringe the intellectual property or proprietary rights of any third party, including, without limitation, any third party patents, copyrights or trademarks. Entrant hereby agrees not to instigate, support, maintain or authorize any action, claim or lawsuit against the Released Parties (defined below), or any other person, on the grounds that any use of the entry as provided herein, infringes any of Entrant's rights as creator of the entry, including, without limitation, trademark rights, copyrights and moral rights. Submission of entry grants Sponsor, and its agents a right and license in perpetuity to reproduce, publish, display, and use any submitted entry for promotional or demonstrative purposes on any Sponsor or partner web properties. Except for any materials in and to which Sponsor expressly retains all right, title and interest, any other elements of all entries, including all international copyrights and all other intellectual property rights in the entries shall be owned exclusively by the Entrant, subject to the rights and licenses granted herein. In no way is Entrant to be construed as the agent of or to be acting as the agent of Sponsor in any way. Nothing herein shall constitute an employment, joint venture, or partnership relationship between Entrant and Sponsor.
13. Release and Limitations of Liability:
- By participating in the Contest, Entrants agree to release and hold harmless the Sponsor and its officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
14. Disputes
- Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in England. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of England and Wales.
15. Payment:
- Unless otherwise noted, there is no purchase necessary to enter and win our Contests. For Contests with entry fees, fees may vary according to the form of payment and/or location of the Entrant. Entry fees are payable using premium text messaging or PayPal in accordance with Sponsor terms & conditions, http://www.amuso.com/terms.
16. Contests Results:
- Contest results may be obtained by sending a self-addressed, stamped envelope to: Project Amuso Ltd, 107 Cheapside, London EC2V 6DN, United Kingdom.
Official Trivia Rules
1. Trivia Overview
- The Trivia Competition ("Trivia") provides users with the opportunity to compete in Trivia competitions and win prizes determined by the criteria set forth below. By participating in Trivia, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the Terms & Conditions of Project Amuso Limited, registered in the UK under company number # 6337515 (“Sponsor”), which shall be final and binding in all respects.
2. Eligibility
- Trivia is open to visitors who have Internet access and are thirteen (13) years of age or older. If we believe that you are under 13 and have registered with us, we will terminate your account. You must have permission from the bill payer to make a deposit in Cash Version of Trivia. Employees of Project Amuso Limited and its respective subsidiaries, affiliates, parent companies, distributors, divisions, and agencies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all federal and local laws and regulations. Void where prohibited by law.
3. Sponsor
- Trivia is sponsored by Project Amuso Ltd, 107 Cheapside, London EC2V 6DN, United Kingdom.
4. Agreement to Official Rules
- Participation in Trivia constitutes the full and unconditional agreement to and acceptance of these Official Rules by you, the entrant ("Entrant") and the decisions of Sponsor which are final and binding. Winning a Prize is contingent upon fulfilling all requirements set forth herein.
5. Timing
- Trivia competitions run continuously and last approximately five minutes from the time of entry (the "Entry Period"). Entrants who exit Trivia competitions during the Entry Period will be disqualified.
6. How To Enter
- To enter Trivia, you must first create a free account with the Sponsor using the Sign Up page and follow the instruction to enter a session. A one-time entry fee of approximately £1.00 (“Payment”) is required to participate in Cash Version.
7. Winning
- The outcome of a Trivia competition is assessed with a points score reflecting the accuracy and speed of entrants’ responses to a series of questions and multiple-choice answers. At the end of a session, the entrant with the highest score is declared the winner. Entrants agree that the Sponsor has the sole right to decide all matters and disputes arising from Trivia and that all decisions of the Sponsor are final and binding.
8. Notification of a Potential Winner
- Entrants are informed of their score and the scores of other entrants throughout Trivia competitions. At the end of a session, a final ranking is published and the player with the highest score is declared the winner. Winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Winner will also be notified by e-mail. If a Winner fails to comply with the eligibility requirements, the Entrant with the next highest score will be deemed the Winner.
9. Prize
- One (1) Entrant with the highest score at the end of a Cash Session will receive a cash prize. The cash prize reflects the sum total of entry fees less a 35% commission to the Sponsor for operating the Service. The Prize is nontransferable and non-refundable and must be accepted as awarded. Winner is solely responsible for any and all applicable fees and taxes associated with prize receipt and use.
